Vaccinations: Legal Exemptions to Vaccination

Medical, philosophical, religious or personal belief exemptions are worded differently in each state. To use an exemption for your child, you must know specifically what the law says in your state. Philosophical Exemption:

The following 18 states allow exemption to vaccination based on philosophical, personal or conscientiously held beliefs: Arizona, Arkansas, California, Colorado, Idaho, Louisiana, Maine, Michigan, Minnesota, New Mexico, North Dakota, Ohio, Oklahoma, Texas, Utah, Vermont, Washington and Wisconsin.

Religious Exemption:

All states allow a religious exemption to vaccination except Mississippi and West Virginia.

The religious exemption is intended for people who hold a sincere religious belief opposing vaccination to the extent that if the state forced vaccination, it would be an infringement on their right to exercise their religious beliefs. Some state laws define religious exemptions broadly to include personal religious beliefs, similar to personal philosophical beliefs. Other states require an individual who claims a religious exemption to be a member of The First Church of Christ, Scientist (Christian Science) or another bonafide religion whose written tenets include prohibition of invasive medical procedures such as vaccination. (This kind of language has been ruled unconstitutional when it has been challenged in state Supreme Courts.) Some laws require a signed affidavit from the pastor or spiritual advisor of the parent exercising religious exemption that affirms the parents' sincere religious belief about vaccination, while others allow the parent to sign a notarized waiver. Prior to registering your child for school, you must check your state law to verify what proof may be needed.

Due to differences in state laws, the National Vaccine Information Center does not recommend or provide a prewritten waiver for religious exemption because it may not conform with what is required in your state, and may actually draw attention to your child, and you may be singled out and challenged.

Medical Exemptions:

All 50 states allow medical exemption to vaccination. Proof of medical exemption must take the form of a signed statement by a Medical Doctor (M.D.) or Doctor of Osteopathy (D.O.) that the administering of one or more vaccines would be detrimental to the health of an individual. Most doctors follow the AAP and CDC guidelines. Most states do not allow Doctors of Chiropractic (D.C.) to write medical exemptions to vaccination.

Proof of Immunity:

Some states will allow exemptions to vaccination for certain diseases if proof of immunity can be shown to exist. Immunity can be proven if you or your child have had the natural disease or have been vaccinated. You have to check your state laws to determine which vaccines in your state can be exempted if proof of immunity is demonstrated.

A major reason why consumers shop for products that are certified organic is to avoid hazardous and unlabeled Genetically Modified Organisms (GMOs), toxic chemicals, and now the most recent, and likely most dangerous hi-tech poison of them all - nanotechnology. Nanotechnology is now a multi-billion dollar Frankenstein monster industry churning out a vast menu of untested and unlabeled products containing tiny nanoparticles including non-organic vitamin supplements, food packaging, processed food, cosmetics, and sunscreens.

The United States Department of Agriculture's National Organic Standards Board (NOSB) has been debating an official ban on nanotechnology in organic. When it meets November 3-5, 2009 in Washington, D.C., the NOSB will consider a recommendation supported by the the OCA and the organic community that would "prohibit nanotechnology in organic production, processing, and packaging."

Nanotechnology is inherently dangerous. Mounting scientific evidence indicates that nanomaterials produce dangerous "free radicals" which can destroy or mutate DNA and can cause damage to the liver and kidneys. Nanotech particles not only injure and kill lab animals - they can kill you as well.

Every day, new evidence of the dangers of nanotechnology emerges:

• Workplace nanoparticle exposure was linked to seven cases of serious and progressive lung disease in China including two patient deaths.

• Nanoparticles present in a chemical found in sunscreens - titanium dioxide - are being examined as possibly causing Alzheimer's and Parkinson's diseases.

Letter on Vitamin D3 and H1N1

Dear Dr. Cannell:

Your recent newsletters and video about Swine flu (H1N1) prompted me to convey our recent experience with an H1N1 outbreak at Central Wisconsin Center (CWC). CWC is a long-term care facility for people with developmental disabilities, home for approx. 275 people with approx. 800 staff. Vitamin D3 (Serum 25-OHD) has been monitored in virtually all residents for several years and patients supplemented with vitamin D.

In June 2009, at the time of the well-publicized Wisconsin spike in H1N1 cases, two residents developed influenza-like illness (ILI) and had positive tests for H1N1: one was a long-term resident; the other, a child, was transferred to us with what was later proven to be H1N1.

On the other hand, 60 staff members developed ILI or were documented to have H1N1: of 17 tested for ILI, eight were positive. An additional 43 staff members called in sick with ILI. (Approx. 11-12 staff developed ILI after working on the unit where the child was given care, several of whom had positive H1N1 tests.)

So, it is rather remarkable that only two residents of 275 developed ILI, one of which did not develop it here, while 103 of 800 staff members had ILI. It appears that the spread of H1N1 was not from staff-to-resident but from resident-to-staff (most obvious in the imported case) and between staff, implying that staff were susceptible and our residents protected.

Dear Dr. Glick:

This is the first hard data that I am aware of concerning H1N1 and vitamin D. It appears vitamin D is incredibly protective against H1N1. Dr. Carlos Carmago at Mass General ran the numbers in an email to me. Even if one excludes 43 staff members who called in sick with influenza, 0.73% of residents were affected, as compared to 7.5% of staff. This 10-fold difference was statistically significant (P less than 0.001). That is, the chance that this was a chance occurrence is one less than one in a thousand. Second, if you read my last newsletter, you will see that children with neurological impairments, like the patients at your hospital, have accounted for 2/3 of the childhood deaths for H1N1 so far in the USA. That is, the CDC knows, because they reported it, that patients with neurological impairments are more likely to die from H1N1.

Thanks for your update about the hospital in Wisconsin. I have had similar anecdotal evidence from my medical practice here in Georgia. We are one of the 5 states with widespread H1N1 outbreaks.

I share an office with another family physician. I aggressively measure and replete vitamin D. He does not.

He is seeing one to 10 cases per week of influenza-like illness. In my practice, I have had zero cases. My patients are universally on 2000-5000 IU to maintain serum levels 50-80 ng/ml.

That’s good news. Now, if we just had a way for the CDC and the NIH to pay attention.

Critics say we should not recommend vitamin D to prevent influenza until it is proven to do so. The critics are thus saying, although they seem not to know it, you should be vitamin D deficient this winter until science proves being vitamin D sufficient is better than being Vitamin D deficient.

This is not rocket science. If I am wrong, and Vitamin D does not prevent influenza, what is lost? A few dollars. If they are wrong, and it does prevent influenza, what is lost?

Please contact your senators and congresspersons. Ask them to have hearings on vitamin D and H1N1:

Study Reveals Serious HPV Vaccine Problems: Fainting, Blood Clots, Death Among Risks

At first glance, a study just published in the August 19th edition of the Journal of the American Medical Association (JAMA) is yet another whitewash job about the safety of the quadrivalent human papillomavirus recombinant vaccine --better known as Gardasil, the genital human papillomavirus (HPV) vaccine. Licensed in June of 2006 by the Food and Drug Administration (FDA) for girls and young women between the ages of nine and 26, the enormously hyped and advertised vaccine is designed to prevent infection with four types of HPV: types 16 and 18 can cause cervical cancer and types 6 and 11 are the most common types of genital warts.

The JAMA report says that the Gardasil adverse events reported have been mostly consistent with data gathered before the vaccine was considered safe enough to be widely administered to young girls. But a closer reading shows some disturbing additional facts. NaturalNews has consistently reported, the vaccine has caused an extraordinary number of adverse side effects (http://www.naturalnews.com/026722_G...). Now comes word from the JAMA report that the HPV vaccine has unexpectedly caused episodes of fainting and life-threatening blood clots. In fact, in a statement to the media, these events were called "disproportional" -- meaning these side effects are anything but rare.

What's more, among the 12,424 adverse reaction reports about the HPV vaccine, 772 (6.2 percent) were serious and included 32 reports of death. Other problems caused by the vaccine include local site reactions, skin rashes, nausea, dizziness, headaches and even Guillain-Barre syndrome (a disorder in which the body's immune system attacks part of the peripheral nervous system sometimes causing paralysis) and anaphylaxis (hypersensitivity reaction that can cause sudden death).

As just reported by CBS news, the teenage daughter of physician Scott Ratner was one of the unfortunate girls who became severely ill with a chronic autoimmune disease, myofasciitis, after her first dose of Gardasil. Dr. Ratner told CBS his daughter was so ill with the neurological problem that "..she'd have been better off getting cervical cancer than the vaccination."

One the lead researchers for Gardasil has also gone public this week, telling CBS news there is no data showing that the vaccine even remains effective beyond five years. That means that if a ten year old girl is given the vaccine and subjected to possibly serious and even life-threatening side effects, the vaccine may offer her no protection at all when she hits her teens or young adulthood.

What makes the debate about Gardasil crazy to begin with is that studies have shown 70 to 90 percent of people with HPV naturally clear the virus from the body within two years of infection -- with no help from drugs or vaccines. So the most effective protection from problems caused by HPV is to avoid being infected by the multiple strains of HPV by not engaging in promiscuous, unprotected sex (the virus is transmitted sexually and condoms do not offer 100 percent protection) and by keeping your body's immune system strong and healthy through good nutrition, exercise and exposure to sunlight.

In an editorial accompanying the JAMA study, Charlotte Haug, M.D., Ph.D., M.Sc., of The Journal of the Norwegian Medical Association in Oslo expressed her concerns about the aggressively promoted Gardasil vaccine: "Whether a risk is worth taking depends not only on the absolute risk, but on the relationship between the potential risk and the potential benefit. If the potential benefits are substantial, most individuals would be willing to accept the risks. But the net benefit of the HPV vaccine to a woman is uncertain.

Whole Foods Threatens to Sue OCA - Please Sign Our Petition

Whole Foods sent a letter dated August 26, 2009, signed by one of its attorneys, threatening to sue the Organic Consumers Association (OCA), under the bizarre pretense that a petition we've been circulating violates Whole Foods' "intellectual property rights." Here's OCA's response to CEO John Mackey:

"Given all the bad publicity that you've gotten lately for admitting that Whole Foods Market (WFM) retail stores are purveyors of 'junk food;' that WFM needs to sell a lot more certified organic products (rather than conventional items greenwashed as 'natural'); that WFM's '365' private label products need to be thoroughly tested for GMO contamination; that you don't think all Americans deserve government subsidized access to health care; or need labor unions; perhaps you may want to reconsider suing the largest organic consumer watchdog organization in the United States..."

Please help put the pressure on Whole Foods and Whole Foods' main distributor, United Natural Foods Incorporated (UNFI), to:

1) Stop prioritizing the sales of conventional foods and products (greenwashed as "natural") and instead double WFM and UNFI's sales of certified organics from 1/3 to 2/3 of their total sales. This would increase US organic sales by approximately $3 billion (15%) annually!

2) Give smaller retailers and coops that seriously promote organics (more than 1/3 of sales organic) the same UNFI discount that Whole Foods receives.

3) Apply Domestic Fair Trade principles to the UNFI and Whole Foods supply chains by guaranteeing workers' rights to freely organize themselves into unions for collective bargaining.

4) Support health care reform to provide universal health care coverage while reducing costs, relieving employers of health care responsibilities, and encouraging wellness and prevention through nutrition and complementary natural medicine.

Historical facts about the dangers and failures of vaccines

Mass vaccination programs not only fail to protect the population from infectious disease, they actually accelerate the spread of disease in many cases. Many website have cropped up over the last few years to counter the pro-vaccine propaganda put out by drug companies (who profit from vaccines) and health regulators (who serve the drug companies).

• In the USA in 1960, two virologists discovered that both polio vaccines were contaminated with the SV 40 virus which causes cancer in animals as well as changes in human cell tissue cultures. Millions of children had been injected with these vaccines. (Med Jnl of Australia 17/3/1973 p555)

• In 1871-2, England, with 98% of the population aged between 2 and 50 vaccinated against smallpox, it experienced its worst ever smallpox outbreak with 45,000 deaths. • In 1978, a survey of 30 States in the US revealed that more than half of the children who contracted measles had been adequately vaccinated. (The People's Doctor, Dr R Mendelsohn)

• The February 1981 issue of the Journal of the American Medical Association found that 90% of obstetricians and 66% of pediatricians refused to take the rubella vaccine.

• In 1979, Sweden abandoned the whooping cough vaccine due to its ineffectiveness. Out of 5,140 cases in 1978, it was found that 84% had been vaccinated three times! (BMJ 283:696-697, 1981)

• In the USA, the cost of a single DPT shot had risen from 11 cents in 1982 to $11.40 in 1987. The manufacturers of the vaccine were putting aside $8 per shot to cover legal costs and damages they were paying out to parents of brain damaged children and children who died after vaccination. • In Oman between 1988 and 1989, a polio outbreak occurred amongst thousands of fully vaccinated children. The region with the highest attack rate had the highest vaccine coverage. The region with the lowest attack rate had the lowest vaccine coverage. (The Lancet, 21/9/91)

• In 1990, a UK survey involving 598 doctors revealed that over 50% of them refused to have the Hepatitis B vaccine despite belonging to the high risk group urged to be vaccinated. (British Med Jnl, 27/1/1990)

• In the USA, from July 1990 to November 1993, the US Food and Drug Administration counted a total of 54,072 adverse reactions following vaccination. The FDA admitted that this number represented only 10% of the real total, because most doctors were refusing to report vaccine injuries. In other words, adverse reactions for this period exceeded half a million! (National Vaccine Information Centre, March 2, 1994)

• In 1990, the Journal of the American Medical Association had an article on measles which stated " Although more than 95% of school-aged children in the US are vaccinated against measles, large measles outbreaks continue to occur in schools and most cases in this setting occur among previously vaccinated children." • In the New England Journal of Medicine July 1994 issue a study found that over 80% of children under 5 years of age who had contracted whooping cough had been fully vaccinated.

• On November 2nd, 2000, the Association of American Physicians and Surgeons (AAPS) announced that its members voted at their 57th annual meeting in St Louis to pass a resolution calling for an end to mandatory childhood vaccines. This isn't the first time the public has been warned about swine flu. The last time was in 1976. It resulted in the massive swine flu vaccine campaign. Within a few months, claims totaling $1.3 billion had been filed by victims who had suffered paralysis from the vaccine. The vaccine was also blamed for 25 deaths. Also, several hundred people developed crippling Guillain-Barré Syndrome after they were injected with the swine flu vaccine. Even healthy 20-year-olds ended up as paraplegics. And the swine flu pandemic itself? It never materialized.

Remember when President Bush said two million Americans would die as a result of the bird flu? In 2005, in 2006, 2007, and again in 2008, those fears were exposed as little more than a cruel hoax, designed to instill fear, and line the pocketbooks of various individuals and industry. I became so convinced by the evidence AGAINST the possibility of a bird flu pandemic that I wrote a New York Times bestselling book, The Bird Flu Hoax, about the massive fraud involved with the epidemic that never happened.

Despite the fantastic headlines and projections of MILLIONS of deaths, the H5N1 bird flu virus killed a mere 257 people worldwide since late 2003. As unfortunate as those deaths are, 257 deaths worldwide from any disease, over the course of five years, simply does not constitute an epidemic.

What is the Swine Flu?

Regular swine flu is a contagious respiratory disease, caused by a type-A influenza virus that affects pigs. The current strain, A(H1N1), is a new variation of an H1N1 virus -- which causes seasonal flu outbreaks in humans -- that also contains genetic material of bird and pig versions of the flu.

Swine Flu is a WEAK Virus

It is important to note that nearly all suspected new cases have been reported as mild. Preliminary scientific evidence is also pointing out that this virus is NOT as potent as initially thought.

Why a True Bird- or Swine Flu Pandemic is HIGHLY Unlikely

You may not know this, but all H1N1 flu's are descendants of the 1918 pandemic strain. The reason why the flu shot may or may not work, however, from year to year, is due to mutations. Therefore, there's no vaccine available for this current hybrid flu strain, and naturally, this is feeding the fear that millions of people will die before a vaccine can be made.

Is Tamiflu Safe?

As soon as Homeland Security declared a health emergency, about 12 million doses of Tamiflu and Relenza treatment courses were released from the nation's stockpile. However, this declaration also allows unapproved tests and drugs to be administered to children.

Common side effects of Tamiflu include the very symptoms you are trying to avoid
Nausea
Vomiting
Diarrhea
Headache
Dizziness
Fatigue
Cough

More serious symptoms included convulsions, delirium or delusions, and 14 deaths in children and teens as a result of neuropsychiatric problems and brain infections (which led Japan to ban Tamiflu for children in 2007). And that's for a drug that, when used as directed, only reduces the duration of influenza symptoms by 1 to 1 ½ days, according to the official data. But making matters worse, some patients with influenza are at higher risk for secondary bacterial infections when on Tamiflu.

Putting Swine Flu into Perspective

Even though swine flu appears to be continuing to spread, you need to know that this is typically a MILD illness. Most cases resolve with no medical care needed whatsoever.

Optimize your vitamin D levels

Optimizing your vitamin D levels is one of the absolute best strategies for avoiding infections of ALL kinds, and vitamin D deficiency is likely the TRUE culprit behind the seasonality of the flu -- not the flu virus itself. This is probably the single most important and least expensive action you can take. I would STRONGLY urge you to have your vitamin D level monitored to confirm your levels are therapeutic at 50-70 ng/ml and done by a reliable vitamin D lab like Lab Corp.

For those of you in the US we hope to launch a vitamin D testing service through Lab Corp that allows you to have your vitamin D levels checked at your local blood drawing facility, and relatively inexpensively, soon. It the meantime, you can also take part in the D*Action Project to have your levels tested as part of a five-year study for public health.

If you are coming down with flu-like symptoms and have not been on vitamin D you can take doses of 50,000 units a day for three days to treat the acute infection. Some researchers like Dr. Cannell, believe the dose could even be as high as 1000 units per pound of body weight for three days.

However, most of Dr. Cannell's work was with seasonal and not pandemic flu. If your body has never been exposed to the antigens there is chance that the vitamin D might not work. The best bet is to maintain healthy levels of vitamin D around 60 ng/ml.

Use Effective Tools to Address Stress

We all face some stress every day, but if stress becomes overwhelming then your body will be less able to fight off the flu and other illness.

The Myth of “Natural Foods” and the Undermining of Organic Foods by Industry Giants

Natural Food Inc. Responds to OCA's Criticisms

In last week's Organic Bytes, OCA criticized Whole Foods Market (WFM) and United Natural Foods for undermining organics by promoting and selling mostly conventional products (greenwashed as "Natural"), instead of certified organic products. OCA and thousands of organic consumers asked WFM & UNFI to begin to put pressure on their so-called "Natural" product suppliers to sign contracts with accredited certifiers and make the transition to organic.

Unfortunately, instead of pressuring these "bottom line" companies to rethink dropping organic ingredients in favor of conventional ingredients, and to stop marketing conventional foods as if they were "as good as" or "nearly organic," WFM and UNFI have "put the squeeze" on a number of OCA's advertisers--costing our organization thousands of dollars in lost revenue. In spite of this blatant intimidation, OCA will not be silent. We will continue to expose the myth of so-called "Natural" foods and farming. We will continue educating ethical consumers, retailers, wholesalers, farmers, and food processors to put their money and their practices where their supposed values lie.

The Myth of Natural Food, Farming, and Products

Walk down the aisles of any Whole Foods Market (WFM) or browse the wholesale catalogue of industry giant United Natural Foods (UNFI) and look closely. What do you see? Row after row of mostly non-organic "natural" (i.e. conventional) foods and products. By marketing sleight of hand, these conventional foods, vitamins, private label "365" items, and personal care products become "natural" or "almost organic" in the Whole Foods setting. The overwhelming majority of WFM products, even their best-selling private label, "365" house brand, are not organic, but rather the products of chemical-intensive and energy-intensive farm and food production factories.

Test these so-called natural products in a lab and what will you find: pesticide residues, Genetically Modified Organisms, and a long list of problematic and/or carcinogenic synthetic chemicals and additives. Trace these products back to the farm or factory and what will you find: climate destabilizing chemical fertilizers, pesticides, fungicides, herbicides, and sewage sludge-not to mention exploited farm workers and workers in the food processing industry. Of course there are many products in WFM (and in UNFI's catalogue} that bear the label "USDA Organic." But the overwhelming majority of their products, even their best selling private label, "365," are not.

What does certified organic or "USDA Organic" mean? This means these products are certified 95-100% organic. Certified organic means the farmer or producer has undergone a regular inspection of its farm, facilities, ingredients, and practices by an independent Third Party certifier, accredited by the USDA National Organic Program (NOP). The producer has followed strict NOP regulations and maintained detailed records. Synthetic pesticides, animal drugs, sewage sludge, GMOs, irradiation, and chemical fertilizers are prohibited. Farm animals, soil, and crops have been managed organically; food can only be processed with certain methods; only allowed ingredients can be used.

On the other hand, what does "natural" really mean, in terms of farming practices, ingredients, and its impact on the environment and climate? "Natural," in the majority of cases is meaningless, even though most consumers do not fully understand this. Natural, in other words, means conventional with a green veneer. Natural products are routinely produced using pesticides, chemical fertilizer, hormones, genetic engineering, and sewage sludge. Natural or conventional products-whether produce, dairy, or canned or frozen goods are typically produced on large industrial farms or in processing plants that are highly polluting, chemical-intensive and energy-intensive. "Natural," "all-natural," and "sustainable," products in most cases are neither backed up by rules and regulations, nor a Third Party certifier. Natural and sustainable are typically label claims that are neither policed nor monitored. (For an evaluation of eco-labels see the Consumers Union website http://www.eco-labels.org/).

The USDA's Food Safety and Inspection Service provides loose, non-enforced guidelines for the use of the term "natural" on meat--basically the products cannot contain artificial flavors, coloring, or preservatives and cannot be more than minimally processed. On non-meat products, the term natural is typically pure propaganda. Companies (like Whole Foods Market or UNFI) are simply telling us what we want to hear, so that we pay an organic or premium price for a conventional product.

Perhaps this wouldn't matter that much if we were living in normal times, with a relatively healthy population, environment, and climate. Conventional products sold as natural or "nearly organic" would be a simple matter of chicanery or consumer fraud. But we are not living in normal times. Pressuring natural and conventional products and producers to make the transition to organic is a matter of life or death. And standing in the way of making this great transition are not only Fortune 500 food and beverage corporations, Monsanto, and corporate agribusiness, as we would expect, but the wholesale and retail giants in the organic and natural products sector, UNFI (United Natural Foods) and Whole Foods Market (WFM).
